Notum sit universis presentem paginam inspecturis, quod super iniuriis et offensis, quas Iustinopolitani domino Bertholdo Dei gratia Aquilegensis ecclesie pathriarcea et Meinhardo comiti Goricie intulerunt, iidem pathriarca et comes taliter ad invicem convenerunt:

Quod dictus comes dominum pathriarcam contra Iustinopolitanos prefatos ad suam iusticiam consequendam ab ipsis bona fide et totis viribus adiuvabit.

Nec compositionem aliquam faciet cum civibus memoratis, nisi ipsi gracie domini pathriarce primittusb fuerint integraliter reformati.

Et econtra, dominus patriarcha idipsum comiti repromisit et nullam cum dictis Iustinopolitanis compositionem admittet, nisi ipsi de iniuriis et offensis satisfaciant, quas eidem comiti irrogarunt.

The offenses committed by the people of Koper against the patriarch and his advocate, Count Maynard III of Gorizia, remain unknown. De Vergottini (cited above) hypothesized that the offenses were committed during the brief hostilities between Piran and Koper in 1231 (cf. Thesuari claritas, ed. Bianchi, doc. 554, p. 229), precisely during the time in which Maynard III of Gorizia was the Piranese podesta (De Franceschi, Chartularium Piranense, Atti e memorie della Società istriana di archeologia e storia patria 36 (1924): doc. 78, p. 106, where “M. comitis Goricie” is erroneously read as “Marquardi” instead of “Meinhardi”). This hypothesis is difficult to support, seeing that seven years went by between the war and the promulgation of this act.

It is much more probable that the “offenses” cited in the document refer to the election of the podestà, something that gravely angered Patriarch Berthold. This hypothesis is further strengthened by the fact that a couple of months later, in October of 1238, Emperor Frederick II officially ratified a treaty between the Commune of Koper and Patriarch Berthold (signed sometime between January and September of 1238), that dealt precisely with the modalities of the elections of podestàs (doc. 1238_FBI). Unfortunately, this treaty is not preserved in extenso, but only as a short regestum in Thesauri claritas (quoted under Medieval Recollections).

The document is notable for being the first case of the lords of Duino appearing as ministerials of the Aquileian patriarch (see Štih, cited above). However, contrary to Štih’s claims, this is not the only time that the members of House Duino would appear as Aquileian ministerials. In January of 1251, during the promulgation of an arbitrational sentence regarding the disputes between Patriarch Berthold V and Count Maynard III of Gorizia, the same Woscalc again appeared as the ministerial of the Aquileian patriarch (see doc. 1251_SA). Subsequently, however, the lords of Duino will regularly appear as the ministerials of the counts of Gorizia. Nevertheless, the two documents show that the House of Duino was originally the service nobility of Aquileian patriarchs, from whom they held their numerous possessions in the Karst, Istria, and “Merania” (territory between the Učka mountain range and the River Rječina).
