Otto announces to all the subjects of the Empire in Italy that he has appointed Patriarch Wolfger of Aquileia imperial legate for Lombardy, Tuscia, the Duchy of Spoleto and the Marches of Ancona and Romaniola, commanding them to receive him honorably and to recognize his decisions in imperial affairs.
Otto dei gratia Romanorum rex et semper augustus dilectis fidelibus suis archiepiscopis, episcopis, marchionibus, comitibus, nobilibus, capitaneis, potestatibus, consulibus, civitatibus et earum Communi omnibusque Imperii fidelibus per Italiam constitutis gratiam suam et bonam voluntatem.
Equitatis regie semitam diligenter investigare et subiectorum commodis providere sollicitudinis nostre congruum exigit propositum, dumque varietate negotiorum, quibus nos frequenter preocupari necesse est, exequi non valemus, vicem nostram discretis et idoneis viris delegare omnimoda ratione instauramur.
Quocirca universitati vestre duximus intimandum quod nos, de prudencia karissimi principis nostri Wolfgeri patriarche Aquilegensis plurimum presumentes et quod Imperio semper fidelissimus extiterit et nobis quoque perpetuo devotissimus esse debeat non inmerito perpendentes, ipsum pro communi omnium vestrorum tranquillitate et pace ad partes Italie destinavimus, et tam in Lonbardia quam per universam Tusciam necnon in Ducatu Spoleti et Marchia Anconitana et Romaniolea legationis nostre officio perfrui plenissimam sibi donavimus facultatem, volentes quoque, ut ipse absque alicuius inpedimenti molestia de hiis omnibus se intromittat, que ad imperialem spectare dinoscuntur iurisdictionem, et in ipsis commodum nostrum ordinet et disponat.
Mandamus igitur vobis monentes et regia auctoritate firmiter precipientes, quatenus memorato principi nostro patriarche Aquilegensi per omnia intendatis et debiti honoris reverentia eum prevenientes super universis negotiis vestris que cum Imperio tractanda habetis, tamquam si nos presentes essemus, ad ipsum habeatis respectum certissime scituri, quod ipse in cunctis agendis nostris pro arbitrio suo et ad honorem Imperii plenissimam habet facultatem. Et quicquit ex parte nostra fecerit vel cuiquam promiserit, nos ratum tenebimus et apud eminenciam nostram perenni gaudebit firmitate.

Patriarch Wolfger had already been made imperial legate in Italy by King Philip, Otto’s rival and predecessor, although the charter of this appointment has not been preserved. There are, however, documents attesting to Wolfger’s legation in Italy in May of 1208 (Reinahrd Härtel, "Wolfger und das Schriftwesen in Oberitalien," in Wolfger von Erla, Bischof von Passau (1191-1204) und Patriarch von Aquileja (1204-1218) als Kirchenfürst und Literaturmäzen, ed. Egon Boshof and Fritz Peter Knapp (Heidelberg 1994), doc. WA 10, p. 186). Thus, the newly recognized King Otto IV simply confirmed this appointment, very much like he confirmed Wolfger’s investiture of imperial regalia (doc. 1209_W4).
Wolfger would serve as Otto IV’s imperial legate in Italy from January of 1209 to May of 1210, his faithful service ending with a re-issuing of the donation charter bestowing the Margraviate of Istria to the Patriarchate of Aquileia (doc. 1210_OIV; for Wolfger’s itinerary as imperial legate, see Buttazzoni’s and Paschini’s accounts cited above).
This is one of the five charters promulgated in Wolfger's favor by the newly recognized King Otto IV during the imperial Diet of Augsburg, a "reward" for the patriarch's support of the newly crowned Roman king following the death of Philip of Swabia, Otto IV's rival to the throne that Wolfger had originally backed.
