The Venetian Senate appoints the captain of Sveti Lovreč and the podestà of Motovun to a committee tasked with examining and settling, together with the envoys of the Patriarch of Aquileia (Marquard of Randeck), disputes between the subjects of Venice and the Patriarchate of Aquileia in Istria.

Quod pro sedandis et removendis omnibus controversiis et  differrentiis que oriri possent inter subditos nostros et subditos domini patriarche Aquilegensis1 in partibus Ystrie, et [cum]a ipse dominus patriarcha hoc instanter requirat per nuntium et litteras suas et offerrat se paratumb mittere suos nuntios cum plena libertate ad partes predictas, vadit pars:

Quod comittatur capitaneo nostro Paysnatici Sancti Laurentii2 et potestati nostro Monthone3 quatenus unaac cum nuntiis domini patriarche audiant querellas et petitiones ac deffensiones subditorum nostrorum Ystrie ac querellas et petitiones subditorum dicti domini patriarche et deffensiones cuiuslibet partium. Et auditis ac intellectis et examinatis diligenter iuribus et deffensionibus utriusque partis unaac cum nuntiis dicti domini patriarche diffiniant, concordent et determinent sicut videbitur fore iustum, et de prudentia sua plene confidimus, ita quod subditi utriusque partis habeant merito contentari.

Medieval Recollections

The present motion was turned into two ducal letters issued on July 28, 1367, to Albano Morosini, the incumbent captain of Sveti Lovreč, and Ermolao Venier, the incumbent podestà of Motovun. These two ducal letters are preserved only in their Italian translation, appended to the translated statute of Oprtalj (the only surviving text of Oprtalj’s statute) together with the arbitral award issued on September 3, 1367. These texts will be edited here following the publication of the critical edition of the Statute of Oprtalj.

Editor's Notes

Ermanno Orlando erroneously equated the incumbent patriarch of Aquileia, Marquard of Randeck (1365–1381), with Philip d’Alençon (1381–1387).

The patriarch elected Stephan Virgilius and Renier de Vecchi as his arbiters (August 18, 1367), and the arbitral committee proffered their award on September 3 of the same year (to be edited here following the publication of the Statute of Oprtalj).
