King Philip invests Patriarch Wolfger with imperial regalian rights and attests that his successors do not need to journey to German lands to receive the regalian investiture because the patriarchs of Aquileia are one of the Italian ecclesiastical princes.

Regalis magnificentie invariabilis equitas potestatis sue iura digne et laudabiliter exequitur cum unicuique id, quod iuris sui est, directo modernationis tramite recognoscit immoa largitur.

Inde est, quod cum habere videatur ratio, quod patriarche Aquilegensis ecclesie, eo quod sint principes Ytalieb, ab recipiendum ab Imperio sua regalia in Alemania[m]c scitari non debeant, contigit tamen quosdam ex ipsis in dictis partibus investiri. Dominus vero Volferus patriarcha, cum a Sede Apostolica missus in civitatem Nurenberc ad nos accederet et ad hec exigeretur ut a nobis regalia sua susciperet, allegare cepit, quod ad id faciendum propter predictam rationem non esset in Alemania constringendus.

Satis ergo concessimus, cum non debere constringi asseverantes tamen, quod si non vocatus ab Imperio intrare[t]d Alemaniam, quod bene deberet ibidem regalia suscipere, quemadmodum quidam sui fecisse dignoscunture predecessores. Ipse vero diu renitens tandem tamen inclinatus a nobis suscepit regalia, postulans sibi dari privilegium quod et fecimusf in hunc modum, ne hoc factum suum per successionemg temporum quandoque in commune deductum vel Imperio vel ipsi Aquilegensi ecclesie preiudicaret vel aliquatenus utriusqueh iuri derogareti.

Ad huiusj itaque facti perennem memoriam presentem paginam conscribi iussimus, et regiak maiestatisl karactere consignari.

Statuentes et regia auctoritate percipientes, ne cuiquam hominum hanc recognitionem nostram licitum sit perperam interpretari vel ei in aliquo temeritatis ausu obviare.

Editor's Notes

As an Italian prince, the Patriarch of Aquileia had the right to receive the investiture of regalian rights from the ruler in Italy and was not supposed to be summoned to German lands to receive it. With the present charter, issued at Wolfger’s request, the patriarch wanted to ensure that no precedent would be set with this investiture of regalian rights in German lands (Schmidinger, cited above).

It should be noted that, at least according to Gislebert of Mons (c. 1150–1225), Patriarch Gottfried (1182–1194) could still be considered a “German prince”: “Et Theutonie princeps aderat unus tantummodo, scilicet patriarcha Aquilee.” (Chronicon Hanoniense, ed. Wilhelm Arndt, MGH, SS 21 (Hannover 1869), p. 575). Patriarch Wolfger, it would seem, aimed to finally make it clear to which part of the Imperium the Church of Aquileia officially belonged.

The charter was confirmed, or better say, reissued, by King Otto IV to the same Patriarch Wolfger during the imperial Diet at Augsburg on the 13th of January, 1209 – to be edited here presently.
